Terms and Conditions

These Terms and Conditions (“Terms”) govern your purchase of goods from baghpathouse.com, operated by Baghpat House Exports Pvt. Ltd. (“Baghpat House”, “we”, “us”, “our”). By placing an order, you agree to these Terms in full. If you do not agree, do not place an order.

These Terms should be read alongside our Privacy Policy, Cookie Policy, and Delivery Policy, all of which are available on our website and form part of the agreement between you and Baghpat House.

2. EU RESPONSIBLE PERSON (GPSR)

In accordance with Regulation (EU) 2023/988 (General Product Safety Regulation), the following entity acts as our authorised representative in the European Union for matters of product safety and compliance:

The EU Responsible Person is authorised to receive communications from market surveillance authorities, maintain and provide access to technical documentation and declarations of conformity, and cooperate with competent authorities on corrective actions. Their contact details will also appear on product labelling and packaging as required by the Regulation.


3. SCOPE AND ACCEPTANCE

These Terms apply to all orders placed through baghpathouse.com by individual consumers. They do not apply to wholesale, trade, or business-to-business orders, which are governed by separate written agreements.

If you are a consumer in the European Union or the European Economic Area, nothing in these Terms reduces or removes any statutory right you hold under the law of your country of habitual residence. Where these Terms conflict with mandatory consumer law, the law prevails.

If you are a consumer in the United Kingdom, your rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 are unaffected by these Terms.

By completing an order, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction, if higher) and have legal capacity to enter into a binding contract.


4. CONTRACT FORMATION

An order submitted through baghpathouse.com is an offer to purchase. No contract exists between you and Baghpat House until we send you an order confirmation email. The contract is formed at that point, not at the time of dispatch.

We reserve the right to refuse or cancel any order before dispatch for any of the following reasons: stock unavailability, payment failure, suspected fraud, pricing error, or where we are unable to verify your identity or delivery address.

Where an order is cancelled after payment, we will issue a full refund within 14 calendar days via the original payment method.

We are not responsible for errors in your order — including incorrect size, quantity, colour selection, or delivery address — once the order confirmation has been issued. If you discover an error, contact info@baghpathouse.com immediately. We will act to correct it only if the order has not yet been packed for dispatch.


5. PRODUCT DESCRIPTIONS AND NATURAL VARIATION

All Baghpat House products are handcrafted from natural materials including, but not limited to, rattan, water hyacinth, raffia, palm leaf, bamboo, and leather. The following are inherent characteristics of handcrafted natural-material goods and are not defects:

  • Variation in colour, shade, and tone between individual pieces

  • Variation in weave density, texture, and surface finish

  • Minor dimensional variation of up to 10% of stated dimensions

  • Natural marks, grain variations, and surface irregularities in leather

  • Gradual colour change and patina development with use and light exposure

  • Minor asymmetry consistent with hand-production methods


Product images on baghpathouse.com are representative. The item you receive will closely resemble the image shown but may not be identical. Colour accuracy depends on your screen settings and is beyond our control. This is a feature of handcrafted production, not a failure of description.

Where an item materially and substantially departs from its written description — beyond the natural variations described above — your statutory rights apply as set out in Section 11.

We take reasonable care over product descriptions and dimensions. We are not liable for minor inaccuracies that do not affect the fundamental nature, purpose, or use of the product.


6. PRICING AND PAYMENT

All prices on baghpathouse.com are displayed in Euros (€) unless otherwise indicated. Prices are correct at the time of display. The price applicable to your order is the price shown at the time you place the order.

We may correct pricing errors at any time. If a pricing error is discovered after your order confirmation but before dispatch, we will notify you and offer you the choice of confirming the order at the correct price or cancelling for a full refund. If we cannot reach you within 3 business days, we will cancel the order and refund in full.

Prices shown include applicable Indian taxes. Import duties, customs charges, and VAT or sales tax assessed by your country’s customs or tax authority upon arrival are the buyer’s responsibility and are not included in the purchase price. We have no control over these charges and cannot predict their amount.

We accept payment by the methods displayed at checkout. All transactions are processed in Euros. Your bank may apply a currency conversion fee if your account is in a different currency; this is outside our control.

We are not liable for losses arising from reliance on a price displayed in error, provided we act promptly to correct the error and notify affected customers.


7. DELIVERY AND RISK

We dispatch goods from India. Estimated delivery times are set out on our Delivery Policy page and are estimates only, not guarantees.

Under EU consumer law (Directive 2011/83/EU, Article 18), our default obligation is to deliver within 30 calendar days of order confirmation unless a different timeline is agreed at the time of ordering. For made-to-order or customised items, the production and delivery timeline communicated at the time of ordering constitutes the agreed delivery period.

Title and risk in the goods pass to you upon delivery to the address specified in your order, or upon delivery to the carrier if you have arranged your own shipping.

We are not liable for:

  • Delays caused by customs examination, duties assessment, or regulatory inspection by any authority in any country

  • Delays or losses caused by the courier or postal service after dispatch from our facility

  • Goods lost or damaged after confirmed delivery to your address

  • Delays caused by circumstances beyond our reasonable control (see Section 13)

  • Incorrect or incomplete delivery addresses provided by you


Non-receipt claims: If tracking shows delivery but you have not received the goods, notify us within 7 business days of the confirmed delivery date. We will open a courier investigation on your behalf. Claims reported more than 7 business days after confirmed delivery cannot be accepted.

Visible damage: If your order arrives visibly damaged, photograph the outer packaging and the item before unpacking further. Report to info@baghpathouse.com within 48 hours of delivery with your order number and photographs. We cannot accept visible external damage claims reported after 48 hours of delivery.

This 48-hour window applies to visible, external damage only. It does not limit or affect your rights in respect of latent (hidden) defects, which are covered by your statutory rights under Section 11.


8. RIGHT OF WITHDRAWAL — EU AND UK CONSUMERS

 

8.1 Your right

If you are purchasing as a consumer in the European Union (under Directive 2011/83/EU) or the United Kingdom (under the Consumer Contracts Regulations 2013), you have the right to withdraw from your purchase within 14 days of the date you — or a person you nominate — receives the goods, without giving any reason.

If we fail to inform you of this right before or at the time of purchase, the withdrawal period is extended to 12 months from the date of delivery.

 

8.2 How to withdraw

To exercise your right of withdrawal, notify us in writing before the 14-day period expires. You may contact us at:

  • Or by using the Model Withdrawal Form set out in Section 17 of these Terms


After notifying us, you must return the goods to us within 14 days of your notification.

 

8.3 Refund

Upon valid withdrawal, we will refund:

  • The full purchase price of the goods; and

  • The cost of standard delivery you paid to receive the goods (if you selected a premium or express delivery option, we will refund only the cost of our least expensive standard delivery option; the supplementary cost is not refundable).


We will issue this refund within 14 calendar days of receiving notification of your withdrawal. However, we may withhold the refund until we have received the goods back, or until you provide proof of their return dispatch, whichever occurs first.

The refund will be made using the same payment method you used for the original transaction. No fee will be charged to you as a result of the refund.

We will not deduct a restocking or handling fee from your refund.

 

8.4 Return costs

The direct cost of returning the goods to us is your responsibility, unless we have agreed otherwise or failed to inform you that the cost falls on you. We recommend using a tracked and insured service. If goods are lost in transit on the return journey, the risk and loss are yours.

 

8.5 Condition of returned goods

You may handle the goods only to the extent necessary to establish their nature, characteristics, and functioning — equivalent to what you would do in a physical shop. If you handle the goods beyond this and their value diminishes, we may deduct the amount of that diminishment from your refund.

 

8.6 Exceptions

The right of withdrawal does not apply to:

  1. Goods made to your individual specification or clearly personalised at your request

  2. Sealed goods not suitable for return once opened for hygiene or health protection reasons, where the seal has been broken after delivery


Nothing in this section reduces or restricts your rights under Section 11 (Legal Guarantee of Conformity).


9. RETURNS — GENERAL (NON-EU/UK AND OUTSIDE WITHDRAWAL PERIOD)

Outside the statutory withdrawal period, or for buyers not covered by EU or UK consumer law, we accept returns within 14 days of delivery provided all of the following conditions are met:

  • The item is unused, unwashed, and in its original condition with all original tags and packaging

  • The item is not made-to-order or customised

  • The item is not a sale or clearance item

  • You have contacted returns@baghpathouse.com and received a return authorisation before dispatching the item


We do not accept returns of items damaged through use, alteration, improper storage, or mishandling after delivery.

Risk in returned goods remains with you until we receive them. Use a tracked and insured service. We cannot accept responsibility for items lost or damaged in return transit.

We will process valid returns within 7 business days of receipt and inspecting the item. Refunds will be issued via the original payment method.


10. PRODUCT CARE AND USE

Our products are crafted from natural materials and require appropriate care. Specific care instructions are provided with each product and on our website. Failure to follow care instructions may result in damage that is not covered by any guarantee, warranty, or return policy.

General guidance:

  • Keep products away from sustained moisture, direct heat, and prolonged sunlight

  • Clean with a dry or slightly damp cloth; do not use chemical cleaners, solvents, or abrasive materials

  • Store in a cool, dry place when not in use

  • Leather products may benefit from periodic conditioning with an appropriate leather care product


We are not liable for damage, deterioration, or colour change arising from use other than the stated intended purpose, failure to follow care instructions, exposure beyond normal indoor conditions, or post-delivery modifications or attempted repairs.


11. LEGAL GUARANTEE OF CONFORMITY — EU AND UK CONSUMERS

11.1 EU consumers

Under Directive (EU) 2019/771, we are liable for any lack of conformity that exists at delivery and becomes apparent within two years of delivery. During at least the first year after delivery (and in some Member States, the full two years), any defect is presumed to have existed at delivery. The burden is on us to prove otherwise.

 

 

11.2 UK consumers

Under the Consumer Rights Act 2015, goods must be of satisfactory quality, fit for purpose, and as described. During the first 30 days, you may reject goods that do not conform and receive a full refund. Between 30 days and six months, you have the right to a repair or replacement; if that fails, you are entitled to a refund. Between six months and six years, you must demonstrate the fault existed at delivery.

 

 

11.3 Remedies

If goods are non-conforming under EU law, you are entitled to the following remedies, in this order:

First remedy: Repair or replacement at no cost to you, within a reasonable time, without significant inconvenience.

Second remedy: A proportionate price reduction or full refund, if repair or replacement is impossible, cannot be completed in a reasonable time, cannot be completed without significant inconvenience, or has been attempted and failed.


You may claim an immediate price reduction or termination of the contract (full refund) without first requesting repair or replacement if:

  • Both repair and replacement are impossible

  • We have not completed a remedy within a reasonable time

  • We have stated or demonstrated that we will not provide a remedy

  • The non-conformity is sufficiently serious to justify immediate termination


A termination refund will be issued within 14 calendar days of your notification, via the original payment method.

11.4 Natural variation exclusion

The natural variation described in Section 5 does not constitute non-conformity. A handcrafted item varying within the range described in Section 5 is conforming. Where an item materially departs from its written description beyond such natural variation, this Section 11 applies in full.


12. LIMITATION OF LIABILITY

 

 

12.1 What we do not limit or exclude

Nothing in these Terms limits or excludes our liability for:

  • Death or personal injury caused by our negligence

  • Fraud or fraudulent misrepresentation

  • Your statutory conformity rights under Section 11

  • Our obligation to refund delivery costs on valid withdrawal under Section 8

  • Any other liability that cannot lawfully be limited or excluded under applicable EU, UK, or Indian law

12.2 Indirect losses

To the fullest extent permitted by applicable law, we are not liable for indirect, consequential, incidental, or special loss or damage, including loss of profit, loss of revenue, loss of use, or any loss not arising directly and naturally from our breach.

12.3 Cap on direct liability

Our total aggregate liability for any claim or series of related claims arising from or connected with a purchase — including claims for defective goods, non-delivery, and breach of contract — is limited to the total purchase price paid for the specific item or items giving rise to the claim.

This cap does not limit your right to a refund of delivery costs under the EU or UK withdrawal right (Section 8) or a conformity refund (Section 11), which are statutory rights preserved under Section 12.1.

12.4 Third parties

We are not liable for acts or omissions of couriers after dispatch, payment processors, customs authorities, tax authorities, or any third party not acting directly as our agent.

12.5 Website accuracy

We take reasonable care to maintain accurate product information on baghpathouse.com. We are not liable for losses arising from temporary inaccuracies, website downtime, or technical failures, provided we act promptly to correct them upon becoming aware.


13. FORCE MAJEURE

We are not in breach of these Terms, nor liable for delay or failure to perform, where such failure arises from causes beyond our reasonable control, including but not limited to:

  • Natural disaster, flood, drought, earthquake, or severe weather

  • Epidemic, pandemic, or public health emergency

  • Fire, explosion, or industrial accident

  • War, civil unrest, terrorism, insurrection, or government action

  • Import or export restriction, embargo, sanction, or customs intervention

  • Disruption to courier, freight, or postal services

  • Industrial action not involving our own employees

  • Power, internet, or telecommunications failure

  • Failure or disruption of payment processing systems


We will notify you as soon as reasonably practicable of any force majeure event affecting your order, stating its nature and expected duration. If the event continues beyond 30 calendar days, either party may cancel the affected order, and we will refund any payment made within 14 calendar days of cancellation.


14. INTELLECTUAL PROPERTY

All content on baghpathouse.com — including but not limited to text, photography, product images, the Baghpat House name, wordmark, logo, and website design — is owned by Baghpat House Exports Pvt. Ltd. and is protected by applicable copyright, trademark, and design rights under Indian and international law.

You are granted a limited, personal, non-exclusive, non-transferable, revocable licence to access and use this website for personal, non-commercial purposes only. This licence does not extend to systematic downloading, scraping, data mining, or commercial reproduction of any kind.

No part of the website content may be reproduced, distributed, modified, or republished without prior written permission from Baghpat House Exports Pvt. Ltd.


15. GOVERNING LAW AND DISPUTE RESOLUTION

15.1 EU consumers

If you are a consumer habitually resident in a Member State of the European Union, these Terms do not deprive you of the protection of the mandatory consumer law provisions of your country of residence. You retain the right to bring proceedings before the courts of your country of habitual residence. Any choice of Indian governing law in these Terms applies only to the extent that it does not deprive you of protections afforded by mandatory EU consumer law.

We acknowledge your right to use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr for the resolution of consumer disputes, though we are not obliged to participate in alternative dispute resolution proceedings.

15.2 UK consumers

If you are a consumer habitually resident in the United Kingdom, these Terms do not deprive you of the protections of the Consumer Rights Act 2015 or other mandatory UK consumer legislation. You retain the right to bring proceedings in England and Wales, Scotland, or Northern Ireland.

15.3 All other buyers

For all buyers not covered by Section 15.1 or 15.2, these Terms are governed by and construed in accordance with the laws of India. All disputes arising from or in connection with these Terms or any purchase shall be resolved by arbitration in Gurugram, Haryana, India, under the Arbitration and Conciliation Act, 1996 (as amended), before a sole arbitrator appointed by mutual agreement. If the parties cannot agree on an arbitrator within 30 days of a written request, the appointment shall be made in accordance with the Act. The language of arbitration shall be English. The arbitral award shall be final and binding.


16. GENERAL PROVISIONS

Severability: If any provision of these Terms is found unenforceable or invalid by a court or competent authority, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remainder of these Terms shall continue in full force and effect.

Waiver: Our failure to enforce any provision on any occasion does not constitute a waiver of our right to enforce that or any other provision in the future.

Entire agreement: These Terms, together with our Privacy Policy, Cookie Policy, and Delivery Policy, constitute the entire agreement between you and Baghpat House for your purchase. This is subject to any rights that cannot be excluded or limited by law and to any pre-contractual representations that induced your purchase.

Assignment: We may assign or transfer our rights and obligations under these Terms to another organisation. We will notify you if this happens and ensure your rights are not reduced. You may not assign or transfer your rights under these Terms without our prior written consent.

Third-party rights: These Terms are between you and Baghpat House. No other person has any right to enforce any of its terms.

Changes: We may update these Terms from time to time. The Terms in force at the time you place your order govern that order. Material changes will be notified on the website in advance of taking effect. Your continued use of the website after changes are posted constitutes acceptance of the updated Terms for future orders.

Language: These Terms are published in English. If translated into any other language, the English version prevails in the event of conflict.


17. MODEL WITHDRAWAL FORM (EU AND UK CONSUMERS)

Complete and send this form only if you wish to exercise your right of withdrawal under EU Directive 2011/83/EU or UK Consumer Contracts Regulations 2013. You are not required to use this form; any clear written statement of your decision to withdraw is sufficient.
